These Terms and Conditions govern use of empirepartners.net and EMPIRE’s related website features, including our quiz, newsletter signup, and call booking. EMPIRE Partners, LLC ("EMPIRE," "we," "us") operates the website from Colorado. Please read these terms before using those features. Where we ask you to accept these terms, your acceptance applies to the relevant use or interaction.

The website does not accept payments or enroll you in a paid membership. Paid coaching, consulting, events, and other client services require separate arrangements and are governed by their applicable agreements. Booking a call or taking a quiz does not enroll you in a paid service. If a signed client agreement conflicts with these terms about client services, the client agreement controls.

Who may use the website

The website is intended for users age 18 or older. If you accept these terms on behalf of a business, you represent that you have authority to bind that business.

Information and quiz results

Our content and quiz results provide general business education and information. They are not legal, tax, financial, investment, medical, or mental-health advice. Website use, quiz participation, and call booking do not create an attorney-client, fiduciary, or other professional advisory relationship.

Quiz results reflect the responses you provide and are intended to help you explore business priorities. They do not establish a definitive diagnosis of your business or guarantee that any recommendation will produce a particular result. Obtain advice from an appropriately qualified professional when your circumstances call for it.

Results and testimonials

Testimonials describe individual experiences in particular circumstances. Outcomes depend on factors including the business, market, resources, implementation, and timing. We do not promise any revenue, profit, growth, conversion rate, or other outcome. Any specific qualification or disclosure accompanying a claim should be read with that claim. This section does not limit any rights you have concerning misleading statements under applicable law.

Our content and trademarks

Website text, graphics, logos, videos, audio, quiz materials, and frameworks are owned by EMPIRE or used with permission. Path to Mastery™ and Close Everyone™ are trademarks claimed by EMPIRE Partners, LLC. Other names and marks belong to their respective owners; a reference does not by itself imply an affiliation or endorsement.

You may view the website, share links, and quote short excerpts with attribution and a link to the source. Unless we authorize it in writing or applicable law permits it, you may not reproduce, sell, republish, distribute, or create derivative works from our protected content. These terms do not restrict fair use or other rights that cannot lawfully be restricted.

Acceptable use

Do not use the website unlawfully; interfere with its operation or security; attempt unauthorized access; introduce malicious code; submit spam or knowingly false information; impersonate another person; or use automated tools to scrape or collect website content without our permission. Do not submit information you are not entitled to provide.

Information you submit

Provide accurate contact and booking information and update us if it changes. Our Privacy Policy explains how we handle personal information. Do not submit sensitive personal information or another person’s confidential information through public-facing forms.

If you voluntarily send nonconfidential suggestions about improving our website or services, you allow us to use those suggestions without payment or an obligation to adopt them. This permission does not transfer ownership of your business materials or authorize use of personal information outside our Privacy Policy.

Booking and communications

Booking is subject to availability and confirmation. If you need to cancel or reschedule, use the instructions in your confirmation or contact [email protected]. We may contact you about your request or appointment. Marketing-text consent is separate from booking and is not a condition of purchase.

Text messages

If you separately agree to receive texts, EMPIRE Partners, LLC may send automated marketing and appointment text messages to the mobile number you provide. Marketing may include information about our programs, events, and offers. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase.

Reply STOP to opt out. You may receive one nonmarketing confirmation of your request. We will honor other reasonable revocation requests as required by applicable law; you can also contact [email protected]. Reply HELP for help or email us at that address. Provide a number you are authorized to use and tell us if you give it up or change it.

Messages may be delayed or undelivered, and wireless carriers are not liable for delayed or undelivered messages. Text-message consent and opt-in records are used to operate and document our messaging program and are not provided to advertising platforms. Our Privacy Policy separately describes phone-number use for advertising audience matching. Agreeing to texts does not itself authorize that separate use.

Third party tools and websites

Our website may use third-party scheduling, quiz, communications, or other tools and link to external websites. Their terms may apply to your use of their services. We do not control independent third-party content or promise its accuracy or availability. Nothing in this section excludes responsibility that applicable law places on EMPIRE for its own conduct or handling of your information.

Website availability and warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE OPERATION. These disclaimers do not affect warranties or rights that cannot lawfully be excluded or commitments in a separate client agreement.

Limits on liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EMPIRE AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA, ARISING FROM WEBSITE USE. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING FROM THE WEBSITE AND THESE TERMS WILL NOT EXCEED $100.

These limits concern the free website and related features, not paid services governed by a separate agreement. They do not exclude or limit liability for fraud, willful misconduct, gross negligence, or any liability or remedy that cannot lawfully be excluded or limited. If applicable law restricts a limitation, it applies only to the extent permitted.

Third party claims caused by misuse

To the extent permitted by law, you agree to reimburse EMPIRE for reasonable costs, damages, and legal fees resulting from a third-party claim caused by your unlawful use of the website, intentional misuse, or infringement of another person’s rights through material you submit. This obligation does not apply to the extent the claim results from EMPIRE’s own misconduct or breach.

We will notify you promptly of a claim and reasonably cooperate, at your expense, with its defense. You may control the defense using counsel reasonably acceptable to us. You may not settle a claim in a way that admits fault by EMPIRE, imposes nonmonetary duties on EMPIRE, or fails to fully release EMPIRE without our written consent.

Access and disputes

We may suspend or restrict website access to address misuse, security concerns, legal requirements, or operational needs. This does not change rights under a separate client agreement.

Colorado law governs these terms, excluding conflict-of-law rules and subject to nonwaivable rights under applicable law. Unless applicable law requires otherwise, disputes arising from these terms will be brought in the state courts in Larimer County, Colorado, or the United States District Court for the District of Colorado, and the parties consent to those courts’ jurisdiction.

Before bringing a claim, either party will give the other written notice describing the issue and requested resolution and allow 30 days for discussion. Send notice to [email protected]; we will send notice to your provided contact address. This process does not prevent urgent injunctive relief, a regulator complaint, or filing necessary to preserve a legal deadline, and does not extend a limitation period without written agreement.

Changes and general terms

We may update these terms prospectively and will update the effective date. We will provide reasonable notice of material changes through the website or an appropriate communication and request renewed acceptance where required. Changes will not retroactively govern an existing dispute. If a provision is unenforceable, the remainder continues to apply. A failure to enforce a provision is not a waiver. These terms govern website use; our Privacy Policy describes information practices. Separate client agreements remain separate.
